Debt Recovery

Sybarius assists you in the successful collection of sums owed to you, in Belgium and abroad. Businesses faced with bad payers are likely to experience cash-flow problems and are exposed to a significant risk in the event that the debtor defaults. Sybarius is pleased to offer its experience and meticulous practice to ensure, as far as possible, that your company avoids the detrimental effect of bad payers.

The effectiveness of debt recovery often depends on the time frames given and Sybarius ensures a strict monitoring of all deadlines.

Sybarius keeps you regularly updated on the progress status on the collection of the sums owed to you.

1. Prior to court

Sybarius intervenes to issue formal notice to the debtor and actively manages the response from the latter. Sybarius may conclude, with your agreement, a suitable payment plan complete with the calculation of interest and/or penalties. In the event that the plan is not followed, all sums are in that case due immediately.

2. In-court procedure

Should voluntary payment not be made, the firm will bring the debtor before the court and represent you during the proceedings. The length of the procedure and the result depend on the objections raised by your debtor. For small debts, Sybarius may use a written procedure before a justice of the peace. Once the judgement condemning your debtor is obtained, Sybarius will execute the order with the intervention of a court bailiff responsible for conducting seizures.

3. Out-of-court procedure

In the case of uncontested debts between two companies, Sybarius implements a procedure with a bailiff that does not, initially, involve recourse to the courts. Where the debtor contests, this procedure may then have to be brought before the courts.
